Terms of Service

By accessing or using the Sukan platform — whether via web browser, mobile application, or API — you agree to be bound by these Terms of Service and our Privacy Policy. If you are using Sukan on behalf of a business or organisation, you represent that you have authority to bind that entity to these terms. If you do not agree, you may not use the platform.

Sukan is an online marketplace that connects property owners and agents with prospective tenants and buyers in Sudan. We provide the technology infrastructure — search, listing publication, inquiry routing, and payment processing for listing fees — but we are not a party to any tenancy agreement, sale contract, or other transaction between users. Sukan does not own, manage, or control any of the properties listed on the platform.

By using Sukan, you agree to: (1) Provide accurate, complete, and up-to-date information in any listing, profile, or inquiry you submit. (2) Refrain from sending unsolicited commercial messages (spam) to other users. (3) Comply with all applicable Sudanese laws and regulations, including those governing property ownership, tenancy, and foreign investment. (4) Not use the platform to facilitate money laundering, fraud, or any other unlawful activity. (5) Not attempt to circumvent Sukan's systems, scrape data without authorisation, or interfere with the platform's operation. Violation of these obligations may result in immediate account suspension.

Listings must represent real properties that the poster has lawful authority to rent or sell. We prohibit: fraudulent listings, listings for properties the poster does not control, discriminatory listings that refuse tenants based on ethnicity, gender, religion, or national origin, listings for properties acquired through illegal means, and duplicate or spam listings. Sukan reserves the right to remove any listing at its sole discretion and without prior notice if it violates this policy or applicable law.

Listing fees are charged in USD. Standard listings cost $15 for 30 days; featured listings cost $40 for 30 days. Payment is processed via Stripe (card) or bank transfer. Listing fees are non-refundable once a listing has been published, except where Sukan removes the listing for reasons attributable to Sukan (for example, a technical error in our publishing system). Refund requests must be submitted within 7 days of the original payment to hello@sukansd.com.

Sukan acts solely as a technology intermediary. We do not act as a real estate agent, broker, escrow agent, or legal adviser. We do not verify the legal title to any property, nor do we guarantee the accuracy of any information provided by a landlord or agent. Any transaction entered into between users on the basis of a Sukan listing is between those users alone. Sukan is not liable for any loss arising from such transactions, including but not limited to deposit loss, fraudulent listings, or misrepresentation by a landlord or tenant.

Your use of Sukan is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please read it carefully before using the platform.

Sukan may suspend or terminate your account at any time, with or without notice, for conduct that we determine violates these Terms, poses a risk to other users, or harms the reputation or operation of the platform. You may close your account at any time via your dashboard settings. Upon termination, your listings will be taken offline and your personal data will be handled according to our Privacy Policy retention schedule.

Sukan is not responsible for resolving disputes between users. If you have a dispute with another user arising from a transaction facilitated by Sukan, we encourage you to attempt to resolve it directly. Sukan may, at its discretion, provide information to assist in dispute resolution but is not obligated to do so and will not act as an arbitrator.

These Terms are governed by and construed in accordance with the laws of Sudan. Any dispute arising under these Terms shall be subject to the exclusive jurisdiction of the competent courts of Sudan. Note: the exact governing jurisdiction will be updated once Sukan's legal entity registration is finalised.

We may update these Terms from time to time. We will notify users of material changes by email (if you have an account) and by posting a notice on the platform at least 14 days before the changes take effect. Your continued use of Sukan after the effective date constitutes acceptance of the revised Terms.
